SUBSTANCE ABUSE PROFESSIONAL (SAP) SERVICES FOR VIOLATION OF DOT RULES

Healthy Life EAP provides Substance Abuse Professional (SAP) consultation and services for employers and individuals. Certain employees in the transportation industry are subject to federal drug and alcohol use and testing regulations, under the federal Department of Transportation (DOT) rules Part 40. An employee who violates these regulations must be immediately removed from safety-sensitive functions, and may not be returned to any safety-sensitive functions in the transportation industry until he/she successfully completes a SAP and return-to-duty process. The service agent who is responsible for overseeing this process is a Substance Abuse Professional, or a SAP.

Federal Department of Transportation rules are designed to protect the public. The responsibility of our SAP Services team is to stay up to date on all current rules and regulations so that employers and individuals can be assured that all of the necessary requirements regulated under DOT rules are adequately addressed and met.

There is a very specific process that employers and individuals must adhere to when there has been a DOT violation that requires the removal of an employee from safety-sensitive work before that person can legally return to a safety-sensitive position. The Healthy Life EAP SAP Services team assists the employer and the employee with the DOT violation to remain in compliance with all DOT rules relating to this process.

The SAP provides the link between the organization's DER, the employee, and the professional providing the recommended course of education and/or treatment. Close management of these cases assures compliance and “best practice” objectives so that the proper procedures are followed and there are never any concerns about the outcome of an audit.

DOT requires a SAP to have specific credentials, to have basic knowledge in specified content areas, to complete a comprehensive SAP training, to satisfactorily complete a SAP exam, and to receive regular continuing education in the subject matter.
